dc.description.abstract Rozdział poświęcony jest analizie instytucji tajemnicy medycznej w świetle ustawy z dnia 6 listopada 2008 r. o prawach pacjenta i Rzeczniku Praw Pacjenta. Tajemnica medyczna została przedstawiona jako jeden z kluczowych elementów systemu ochrony praw pacjenta oraz fundamentalna zasada wykonywania zawodów medycznych. W opracowaniu przedstawiono jej znaczenie prawne, etyczne i praktyczne, a także wskazano relacje między obowiązkiem zachowania poufności a prawem pacjenta do prywatności i autonomii informacyjnej. Analiza obejmuje zarówno zakres podmiotowy, jak i przedmiotowy obowiązku zachowania tajemnicy, a także katalog ustawowych wyjątków dopuszczających jej uchylenie, w tym sytuacje wynikające z zagrożenia życia lub zdrowia, zgody pacjenta czy potrzeby wymiany informacji między osobami wykonującymi zawody medyczne. W rozdziale omówiono również podstawy odpowiedzialności karnej za naruszenie tajemnicy medycznej w świetle art. 266 § 1 Kodeksu karnego. Wyniki przeprowadzonych rozważań prowadzą do wniosku, że obowiązujący system prawny zapewnia spójną i wystarczającą ochronę tajemnicy medycznej, jednak jej efektywność w praktyce uzależniona jest od świadomości prawnej i etycznej personelu medycznego oraz skuteczności instytucjonalnego nadzoru. Zachowanie poufności informacji o pacjencie stanowi nie tylko obowiązek prawny, lecz także wyraz poszanowania jego godności, prywatności i praw człowieka w demokratycznym państwie prawnym.
dc.description.abstract The article focuses on the analysis of medical confidentiality under the Act of 6 November 2008 on Patients’ Rights and the Commissioner for Patients’ Rights. Medical confidentiality is presented as a key element in protecting patients’ rights and as a fundamental principle governing the medical profession. The paper examines its legal, ethical, and practical dimensions, emphasising the relationship between the duty of confidentiality and the patient’s right to privacy and informational autonomy. The analysis covers both the subjective and objective scope of the duty to maintain medical secrecy, as well as the statutory exceptions that allow for its disclosure, including situations involving a threat to life or health, the patient’s explicit consent, or the need to exchange information among healthcare professionals involved in the provision of medical services. The article also addresses criminal liability for breaches of medical confidentiality under Article 266 § 1 of the Polish Penal Code. The findings indicate that the current legal framework provides a coherent and adequate foundation for protecting medical confidentiality. Nevertheless, its effectiveness in practice depends largely on healthcare professionals’ legal and ethical awareness and on the efficiency of institutional oversight mechanisms. The maintenance of medical secrecy should therefore be regarded not only as a legal duty but also as an expression of respect for human dignity, privacy, and fundamental rights in a democratic state governed by the rule of law. en
