W rozdziale podjęto problem erozji bazy podatkowej CIT w Polsce i możliwości jego
ograniczenia z wykorzystaniem sztucznej inteligencji (AI) w świetle ustaleń kontroli
NIK z lat 2019 i 2024. Punkt wyjścia stanowi wysoka szacunkowa luka CIT (ok. 26
mld zł, ok. 30% teoretycznych dochodów), brak metodologii pomiaru tej luki oraz
strategii jej przeciwdziałania. Wyniki kontroli NIK ukazały systemową lukę informacyjną,
w tym brak ponad 1 250 400 zeznań CIT-8 i 58 900 zgłoszeń NIP-8, deficyt
specjalistycznego know-how w obszarze CIT oraz niską efektywność czynności
sprawdzających i kontroli, zwłaszcza w niewyspecjalizowanych urzędach skarbowych.
Okoliczności te w istotny sposób ograniczają możliwość efektywnego wykorzystania
potencjału narzędzi AI. W rozdziale przyjęto tezę, że efektywne wykorzystanie AI
do ograniczenia erozji bazy CIT wymaga najpierw uzupełnienia luki informacyjnej, wzmocnienia kompetencji i specjalizacji w CIT oraz uporządkowania procesów egzekucyjnych
i kontrolnych.
The chapter addresses the problem of CIT tax base erosion in Poland and the possibility of limiting it with the use of artificial intelligence (AI) in light of the findings of the Supreme Audit Office (NIK) audits from 2019 and 2024. The starting point is the high estimated CIT gap (approximately PLN 26 billion, approximately 30% of theoretical revenues), the lack of a methodology for measuring this gap, and the lack of a strategy to counteract it. The results of the NIK audit revealed a systemic information gap, including the absence of over 1,250,400 CIT-8 tax returns and 58,900 NIP-8 notifications, a deficit of specialist know-how in the area of CIT, and the low effectiveness of verification and control activities, especially in non-specialized tax offices. These circumstances significantly undermine the effective use of AI potential based on the existing data infrastructure of the National Revenue Administration and within the regulatory framework of the EU AI Act. The chapter argues that the effective use of AI to reduce CIT base erosion first requires filling the information gap, strengthening CIT expertise and specialization, and streamlining enforcement and control processes.
